EasyFuel Fuel Discounting System
These Terms and Conditions constitute the basis of the EasyFuel Fuel Discounting System.
EasyFuel reserves the right to update or amend these terms and conditions by posting the amended terms and conditions at www.easyfuel.com.au. It is your responsibility to check the terms and conditions regularly for any changes.
Participating merchants may impose further conditions in relation to the use and provision of membership cards. Such terms and conditions will be displayed at each participating merchant’s premises.
1 Membership
By completing this Application Form, you are applying for membership of the EasyFuel Fuel Discounting System. If your application is successful, you will be issued with an EasyFuel membership card, which must be produced to the participating merchant when making an EasyFuel Fuel Discounting System purchase transaction.
2 Collecting Fuel Discounts
The participating merchants may credit fuel discounts to a member’s membership card for all eligible purchases. Fuel discounts may also be credited to a member’s membership card for promotional and incentive programs offered by EasyFuel and/or the participating merchants (at the sole discretion of EasyFuel and/or the participating merchants) from time to time.
EasyFuel and/or the participating merchants will determine which goods or services are eligible and the number of fuel discounts that will be credited to a member’s membership card for such eligible purchases. In order to obtain fuel discounts, a member must notify the participating merchant that the purchase transaction is an EasyFuel Fuel Discounting System purchase transaction by presenting their EasyFuel membership card, prior to making payment for the relevant purchase.
EasyFuel are not liable for any failure of a member to notify a participating merchant that the purchase transaction is an Easy Fuel Fuel Discounting System purchase transaction.
EasyFuel is not liable if a participating merchant fails to accept a membership card, or if a terminal displaying the EasyFuel Fuel Discounting System logo is unavailable for use or cannot be used due to malfunction or any other reason.
Fuel discounts cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. Fuel discounts are expressed as “cents off per litre”, which represents a discount off the pump price of the relevant type of fuel displayed at the outlet.
Fuel discounts will expire at the end of the month following the month in which the discounts were awarded.
Members are able to establish the value of the fuel discounts recorded on their card by presenting their card to any participating merchant.
3 Redeeming Fuel Discounts
A member who has accumulated fuel discounts on his or her membership card may request to redeem those fuel discounts by presenting his or her membership card at the time of purchase of fuel from a participating fuel merchant, regardless of where the fuel discounts were issued.
Upon redemption, the total number of accumulated fuel discounts recorded on the member’s membership card expressed as “cents per litre” will be deducted from the displayed pump price of fuel applying at the time of redemption. The discounted price will apply to the member’s purchase of fuel for his or her vehicle at the time of redemption up to a maximum purchase of fifty (50) litres of fuel. If the price per litre of fuel applicable after applying the accumulated fuel discounts is equal to or less than zero (0) cents per litre, the member will not be charged for his or her purchase of fuel used to fill his or her vehicle’s fuel tank at the time of redemption, up to a maximum purchase of fifty (50) litres of fuel. Members may only purchase fuel for one vehicle at the time of redemption and a member may not purchase more fuel than the vehicle’s fuel tank can hold.
All accumulated fuel discounts can be used only once, and will be deducted from the member’s membership card following redemption.
If the member submits a fuel purchase for manual redemption, the dollar value equivalent of litres purchased up to a maximum purchase of fifty (50) litres of fuel multiplied by the total number of accumulated fuel discounts recorded on the member’s membership card expressed as cents per litre will be credited into the members bank account less an administration fee of 55 cents. If the amount to be credited is less than 55 cents, it will be sit against the members account until the balance is higher than 55 cents, at which point it will be remitted.
Fuel discounts may only be redeemed for fuel and cannot be redeemed for cash or other products purchased and only one type of fuel may be purchased with the fuel discounts accumulated on the member’s membership card in each transaction.
Fuel discounts that are not redeemed by the end of the month following the month in which they were credited to a member’s membership card, will be deducted from the member’s membership card when it is next presented to a participating merchant or outlet and will not be redeemable.
4 Termination of the EasyFuel Fuel Discounting System
EasyFuel reserves the right at its absolute discretion to suspend or terminate the EasyFuel Fuel Discounting System at any time without prior notice to members. EasyFuel will not be liable for, and will not provide any refund, compensation or any other form of payout, as a result of the suspension or termination of the EasyFuel Fuel Discounting System on any account whatsoever including (without limitation) the balance of any fuel discounts recorded on a member’s membership card at the time of suspension or termination.
5 Warranties and Liabilities
To the extent permitted by law, EasyFuel takes no responsibility for, and will not be liable in any way for any conditions, guarantees and warranties provided by participating merchants, and all conditions, guarantees and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the EasyFuel Fuel Discounting System are expressly excluded by EasyFuel. Any liability EasyFuel may have to a member under statute or otherwise in respect of such goods and services which cannot be excluded is limited, to the extent permitted by law, to the value of the fuel discounts redeemed towards the purchase price of such goods.
Any liability that EasyFuel may have to a member for negligence, breach of contract or otherwise is limited in any case to the lesser of the dollar value of the member’s accumulated fuel discounts at the time the liability arose, and fifty dollars ($50.00).
The total accumulated value of all redeemables on an EasyFuel card may not exceed a maximum of $900 at any time.
Participating merchants do not have authority, express or implied, to make any representation, warranty or statement on behalf of EasyFuel. EasyFuel accepts no liability in respect of such representations, warranties or statements.
6 In these Terms and Conditions
“accumulated fuel discounts” means the fuel discounts which a member has accrued under the EasyFuel Fuel Discounting System, which are recorded on the member’s membership card, and which have not expired;
“EasyFuel” means EasyFuel Pty Ltd ABN 98 137 258 372 and/or their nominee(s) jointly and severally and their permitted assigns, related bodies corporate and authorised representatives. The term “related bodies corporate” has the same meaning as in the Corporations Act 2001;
“EasyFuel Fuel Discounting System” means the system operated by EasyFuel whereby members that have accrued fuel discounts by making purchases from participating merchants may redeem all of their accumulated fuel discounts for a discount off the price of fuel purchased from the participating merchants in accordance with these Terms and Conditions;
“EasyFuel Fuel Discounting System logo” means the logo approved by EasyFuel Pty Ltd and displayed at the bottom of these Terms and Conditions;
“EasyFuel Fuel Discounting System purchase transaction” means the purchase of fuel by a member, from a participating merchant, which is subject to the EasyFuel Fuel Discounting System;
“eligible purchase’ means a purchase of fuel by a member, from a participating merchant, which is subject to the EasyFuel Fuel Discounting System;
“fuel” means petrol (leaded and unleaded), diesel and gas sold by petrol outlets;
“fuel discounts” means the discounts provided under the EasyFuel Fuel Discounting System, expressed as “cents off per litre” of the price of fuel provided by participating merchants;“member” means a person who has applied to be a member of, and who EasyFuel has approved as a member of, the EasyFuel Fuel Discounting System;
“membership card” means the membership card issued to members under the EasyFuel Fuel Discounting System; and
“participating merchant” means an organisation who has agreed in writing with EasyFuel to offer fuel discounts under the EasyFuel Fuel Discounting System.
